TERMS AND CONDITIONS OF DRIVING TUITION
These Terms and Conditions apply to all driving tuition provided by PassWith Driving School (the Instructor, we, us, our). By booking, paying for, or attending lessons, you (the Pupil, you, your) agree to be bound by these.
1. ABOUT US
1.1 PassWith Driving School provides driver training and driving tuition services within England and Wales.
1.2 Tuition is provided by a DVSA Approved Driving Instructor (ADI) or, where applicable, a DVSA licensed Potential Driving Instructor (PDI).
1.3 The contract for tuition is between the pupil and PassWith Driving School.
2. DRIVING LICENCE REQUIREMENTS
2.1 Pupils must hold a valid UK provisional or full driving licence and be legally entitled to drive.
2.2 Pupils must present their driving licence and permit licence checks when reasonably requested.
2.3 Pupils must immediately notify the instructor of:
Any driving convictions
Any driving disqualifications
Any medical conditions affecting driving
Any changes to their entitlement to drive
2.4 Lessons may be refused where a pupil is unable to demonstrate legal entitlement to drive.
3. BOOKINGS AND PAYMENTS
3.1 Lessons must be booked in advance.
3.2 Payment must be made before lessons commence unless otherwise agreed.
3.3 Block bookings must be paid in full prior to the first lesson.
3.4 Prices may be amended from time to time. Any change will not affect lessons already paid for.
3.5 Promotional offers may be withdrawn at any time and cannot be combined unless expressly stated.
4. LESSON DURATION
4.1 Lessons will be delivered for the duration booked.
4.2 Lesson time includes:
Vehicle safety checks
Lesson debriefs
Route planning
Driving tuition
4.3 The instructor will use reasonable endeavours to start lessons at the agreed time.
5. 48-HOUR CANCELLATION POLICY
5.1 Pupils must provide at least 48 hours notice if they wish to cancel or rearrange a lesson.
5.2 Where less than 48 hours notice is provided, PassWith Driving School reserves the right to charge the full lesson fee.
5.3 This charge reflects the loss suffered because reserved lesson time is unlikely to be rebooked at such short notice.
5.4 Requests to waive cancellation charges due to exceptional circumstances will be considered fairly.
5.5 Failure to attend a lesson without notice will be treated as a non-attendance and charged in full.
5.6 Cancellation requests must be sent directly to the instructor by telephone, text message, WhatsApp, email, or another agreed communication method.
6. INSTRUCTOR CANCELLATIONS AND REARRANGEMENTS
6.1 PassWith Driving School will use reasonable care and skill in delivering booked lessons.
6.2 Occasionally lessons may need to be rearranged due to circumstances beyond the instructor's reasonable control including:
Illness
Vehicle breakdown
Accident
Severe weather
Family emergency
Road closures
Technical failures
Other unforeseen circumstances
6.3 Where a lesson is cancelled by the instructor, a reasonable alternative appointment will be offered as soon as practicable.
6.4 Occasional lesson rearrangements shall not automatically entitle a pupil to terminate the agreement or claim a refund provided reasonable alternative lesson appointments are offered.
6.5 If PassWith Driving School is unable to provide the booked tuition within a reasonable period, the pupil may request a refund for any unused lesson credit.
6.6 Refunds relating to instructor cancellations will be limited to the value of unused lessons not provided.
6.7 PassWith Driving School shall not be liable for indirect or consequential losses including:
Driving test fees
Travel expenses
Accommodation costs
Loss of earnings
7. BLOCK BOOKINGS
7.1 Block bookings are offered at a discounted rate.
7.2 Block booking discounts are conditional upon the full package being used.
7.3 Block bookings remain valid for six months from the date of purchase unless otherwise agreed.
7.4 Any unused lessons remaining after expiry may be forfeited unless an extension has been agreed in writing.
7.5 Pupils may request a refund of unused lessons if a driving test is passed and credit remains.
7.7 Any applicable cancellation charges may also be deducted.
7.8 The remaining balance, if any, will be refunded within 14 days of agreement.
8. LATENESS
8.1 Lessons begin and end at the scheduled times.
8.2 If a pupil arrives late, the lesson will still end at the scheduled time.
8.3 If a pupil is more than 10 minutes late without contact, the lesson may be treated as a non-attendance.
8.4 If the instructor is delayed, reasonable efforts will be made to recover lost lesson time.
9. FITNESS TO DRIVE
9.1 Pupils must ensure they are fit to drive.
9.2 Lessons will not proceed where a pupil appears to be under the influence of:
Alcohol
Illegal drugs
Medication affecting driving ability
9.3 Where a lesson is terminated for safety reasons, the lesson fee may be forfeited.
10. SAFETY AND CONDUCT
10.1 The instructor may terminate a lesson immediately where safety is compromised.
10.2 Abusive, threatening, discriminatory, violent, or inappropriate behaviour will not be tolerated.
10.3 Tuition may be withdrawn where continuation would be unreasonable or unsafe.
10.4 Any unused lesson credit following termination for serious misconduct will be assessed fairly and reasonably.
11. DRIVING TESTS
11.1 Driving tests should be discussed and agreed with the instructor before booking wherever possible.
11.2 The instructor reserves the right to refuse use of their vehicle for a driving test where they reasonably believe:
The pupil is not at test standard
The pupil poses a safety risk
The vehicle may be placed at unreasonable risk
11.3 This decision will be made using professional judgement and road safety considerations.
11.4 Test fees paid to the DVSA remain the pupil's responsibility.
12. USE OF INSTRUCTOR'S VEHICLE
12.1 The instructor's vehicle remains under the instructor's control at all times.
12.2 Smoking, vaping, illegal substances, and dangerous behaviour are prohibited.
12.3 Pupils may be held responsible for deliberate or reckless damage caused to the vehicle.
13. REFUNDS
13.1 Refund requests must be made in writing.
13.2 Approved refunds will normally be processed within 14 days.
13.3 Refunds will be made using the original payment method where reasonably possible.
13.4 Nothing in these Terms excludes a pupil's statutory rights.
13.4.1 Refunds on block booked lessons where the block has started can not be refunded.
14. DATA PROTECTION
14.1 Personal information will be processed in accordance with UK data protection legislation.
14.2 Information will only be used for:
Lesson administration
Communication
Legal and regulatory compliance
14.3 Personal information will not be sold to third parties.
15. CONSUMER RIGHTS
15.1 PassWith Driving School will provide services:
With reasonable care and skill
Within a reasonable time
In accordance with applicable law
15.2 Nothing in these Terms excludes or restricts any rights available under the Consumer Rights Act 2015.
15.3 Where services are not provided with reasonable care and skill, pupils may be entitled to remedies available under consumer legislation.
16. LIMITATION OF LIABILITY
16.1 Nothing in these Terms excludes liability for:
Death or personal injury caused by negligence
Fraud
Any liability that cannot legally be excluded
16.2 Subject to clause 16.3, PassWith Driving School's liability shall be limited to the amount paid for the relevant tuition services.
17. COMPLAINTS
17.1 Any complaint should first be raised directly with PassWith Driving School.
17.2 We will seek to resolve complaints fairly and promptly.
17.3 If a resolution cannot be reached, either party may seek independent advice or pursue any legal remedies available.
18. GOVERNING LAW
18.1 These Terms and Conditions are governed by the laws of England and Wales.
18.2 Any dispute shall be subject to the jurisdiction of the courts of England and Wales.
ACCEPTANCE
By booking, paying for, or attending driving lessons with PassWith Driving School, the pupil confirms that they have read, understood, and accepted these Terms and Conditions.
